These Terms of Service (“Terms”) govern your use of the Gamery Australia website and any purchases made through it. By visiting our site and/or purchasing something from us, you agree to be bound by these Terms.

We may cancel or refuse an order where reasonably necessary, including but not limited to:

5) Shipping & Delivery
Shipping options, costs, and estimated delivery times are shown at checkout. Delivery timeframes are estimates only and may be affected by:

Risk & title:

Title (ownership) transfers to you when the order is dispatched (unless otherwise required by law).

Risk of loss passes to you on delivery, however we will assist with carrier claims where applicable.
If a parcel is marked as delivered by the carrier but you have not received it, contact us promptly so we can help investigate.
6) Sealed Products & Collectibles (Important)
For collectible and sealed items (including TCG products):

Sealed products may have factory imperfections such as minor box wear, seal seams, or shrink wrap variance. These are typically considered normal manufacturing/handling characteristics.

We do not guarantee pull rates, hits, or card quality inside sealed products.
If you receive an item that is genuinely damaged in transit or incorrect, contact us immediately with clear photos.
7) Returns & Refunds
Our Returns & Refunds Policy forms part of these Terms and should be read together with them.
Nothing in our policies is intended to exclude or limit your rights under Australian Consumer Law (ACL).
8) Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a repair, replacement, or refund depending on whether a failure is major or minor. These rights apply regardless of any store policy.
9) Pre-Orders (If Applicable)
If we offer pre-orders:

Estimated release dates are subject to change due to supplier allocation and distribution delays.

Pre-orders may be fulfilled in the order received.

If we cannot fulfil your pre-order due to allocation changes, we will refund you.
10) Promotions, Discount Codes & Gift Cards

Discount codes cannot be combined unless stated.

Gift cards are non-refundable except where required by law.

11) Chargebacks & Payment Disputes
If you believe there is an issue with your order, please contact us first at admin@gamery.com.au so we can work with you to resolve it.
Unauthorised chargebacks may result in order cancellation, account restrictions, or future order refusal where permitted by law.
